The 2007 Special Session - Sine Die May 15

 
The Special Session did not conclude in three days as anticipated by the Governor.   In fact, one Democrat Senator criticized the Governor on his accusations that the legislators failed in their attempts to address the major issues in the regular legislative session.  This Senator’s frustration was shared by many legislators during the two sessions.  We agree that an ultimate solution should be worked on by both legislative houses together as contemplated by the framers of   

HB5– tax rebate and compliance (Lange), was the major tax bill of the Special session.  Our associaiton along with a variety of business groups worked diligently on compromises to allow the department additional compliance tools they thought were necessary.  Despite numerous discussions between House Republicans and the administration, it appeared a compromise was not possible.  
 

Some of the amendments under discussion were:

  1. Central assessment of telephones  - Administration considering taking this out of the bill  
  2. Withholding for non-residents is out. Require electronic reporting of 1099s forms to help the DOR identify non-resident sales.   Other new tools the DOR has implemented to increase compliance is a requirement to list SSN on the Realty Transfer Certificates (RTCs) - adopted by rule, a new educational brochure outlining potential tax liability, statutory authority to allow the Department to contract with out-of-state collectors from delinquent taxes from out-of-state residents.(HB680).  
  3. Further discussion on reportable transactions and the voluntary compliance initiatives.  
  4. Statute of limitations for corporations – DOR continues to want 5 years, which is inconsistent with the federal government and every other state.   
  5. Clarification of pension withholding.
